Whereas, the defendant above named is unde4r Court Order herein, to comply with the July 18, 1994 Findings and Order of this Court awarding custody of the minor child to Jeffrey Allen Imm in the above entitled action; and

Whereas said defendant did not so comply; and

Whereas said court thereupon ordered that the warrant of said court, for the arrest and bringing before it of Defendant, be issued.

Now Therefore these presents are to command you, said Sheriff, to arrest said Defendant and bring her before said Court, to be dealt with in the premises according to law. Or if Court has adjourned, that you deliver her to the custody of the Jailor of Hennepin County. The Defendant shall be held without bail or bond.

WITNESS the HONORABLE JUDGE CHARLES A. PORTER JR., Judge of said District Court, and the seal of said Court, at the city of Minneapolis, in said County and State this April 28th 2008.

IT IS ORDERED:

1.) LET A BENCH WARRANT ISSUE FOR THE ARREST AND APPREHENSION OF THE DEFENDANT. Hold without bail or bond.

2.) Plaintiff/Respondent Collins is hereby held in constructive civil contempt for her ongoing, willful failure to comply with the Custody Order in this case.

3.) The sanction for Collins’ contempt is imprisonment for six months, the maximum time allowed by statute. The purge condition is that Collins immediately surrender the minor child to Imm either directly or thorough appropriate law enforcement who will ensure that Imm has actual custody of the child.

4.) Collins is liable to Imm for all attorney fees and costs incurred by Imm for all of his documented enforcement-related efforts, including all judicial proceedings and extra judicial attempts to enforce the Custody Order. Counsel for Imm shall submit an affidavit of fees and costs to the Court detailing the amounts claimed.

5.) The court will serve by mail a copy of this Order along with a copy of the arrest warrant upon Collins at her current known address in the Netherlands.
